Right of withdrawal

The right of withdrawal applies exclusively to consumers in accordance with § 13 BGB. A consumer is any natural person who concludes a legal transaction for a purpose that can neither be attributed to their commercial nor their independent professional activity.

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of withdrawal, you must send us a clear declaration (e.g. a letter sent by post to Martin Klauka, Edlinger Str. 74, 83071 Stephanskirchen, or by email to info (at) motomogli.com) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the notification that you are exercising your right of cancellation or for the item yourself before the cancellation period has expired.

 

Consequences of withdrawal

If you cancel this contract, we have to repay all payments that we have received from you immediately and at the latest within fourteen days from the date of receipt.

For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the costs for the return if the goods delivered correspond to those ordered. If you cannot return the received service in whole or in part or only in a deteriorated condition, you may have to compensate us for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to its examination of the quality, properties and functionality of the goods - as it would have been possible for you in a shop, for example. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the goods as if you were your property and by refraining from anything that could impair their value. Transportable items are to be returned at our risk.
